{"id":3492,"date":"2008-11-10T17:20:01","date_gmt":"2008-11-10T17:20:01","guid":{"rendered":"http:\/\/tat.reddaisytrading.co.uk\/index.php\/2008\/11\/10\/ice-cream-maker-wins-high-court-case-against-rival\/"},"modified":"2016-01-07T11:23:18","modified_gmt":"2016-01-07T11:23:18","slug":"ice-cream-maker-wins-high-court-case-against-rival","status":"publish","type":"post","link":"https:\/\/www.theasiantoday.com\/index.php\/2008\/11\/10\/ice-cream-maker-wins-high-court-case-against-rival\/","title":{"rendered":"Ice Cream maker wins High Court case against rival"},"content":{"rendered":"<div id=\"content\">\n<h3>Rival sought to \u2018cash-in\u2019on success of Kulfi maker<\/h3>\n<div><strong><img loading=\"lazy\" decoding=\"async\" height=\"293\" hspace=\"10\" width=\"232\" align=\"right\" vspace=\"3\" alt=\"\" src=\"http:\/\/theasiantoday.com\/wp-content\/uploads\/2008\/11\/TubzeeLtd_232x245.jpg\"\/>A HALIFAX-based ice cream manufacturer who supplies leading supermarkets with Kulfi ice cream has won a High Court battle against a rival company who is accused of copying its packaging.<\/strong> <\/div>\n<p>&#13;<\/p>\n<div>Tubzee Limited, who supply supermarket giants Asda and Tesco with its Kulfi ice-cream range, brought the action against local rivals Safron Foods Limited following letters of complaints by a number of its customers. <\/div>\n<p>&#13;<\/p>\n<div>Both companies manufacture and supply Asian ice cream products known as Kulfi. <\/div>\n<p>&#13;<\/p>\n<div>Tubzee, which <a name=\"para22\"><font color=\"#000000\">is headed by brothers\u2019 Khalid Mahmood and Asif Hussain<\/font><\/a>, began the Court action last year in the High Court at Leeds. <\/div>\n<p>&#13;<\/p>\n<div>The claim concerned the recently re-designed packaging of Safron Foods Limited which infringed two of Tubzee\u2019s registered trade marks, the court heard <\/div>\n<p>&#13;<\/p>\n<div>Judge John Behrens ruled that the packaging was sufficiently similar to cause confusion on the part of consumers, who may have believed they were purchasing Tubzee products when in fact they were Safron Foods\u2019 products.<\/div>\n<p>&#13;<\/p>\n<div>The claim was against the Company and two former Directors, Tanvir Hussain and Mudasar Mahboob.<\/div>\n<p>&#13;<\/p>\n<div>Judge Behrens found that as well as the company being liable, the two individuals were personally liable for allowing the company to have infringed the trade marks and passed-off their products as those of Tubzee Limited. <\/div>\n<p>&#13;<\/p>\n<div>Tubzee\u2019s lawyer, Luke Patel, said Safron \u201csought to cash-in\u201d on the rising success of their rivals.<\/div>\n<p>&#13;<\/p>\n<div>He added: \u201cUnderstandably, Tubzee could not allow this to continue and were forced to take Court action to protect their long-established brand. <\/div>\n<p>&#13;<\/p>\n<div>That action was successful in its entirety. Not only the Company, but also the two former Directors, were found to be responsible, which shows the Courts will not allow Directors to hide behind their Companies. Permission to appeal the decision to the Court of Appeal was refused.
