{"id":27787,"date":"2018-12-07T11:49:14","date_gmt":"2018-12-07T11:49:14","guid":{"rendered":"https:\/\/www.theasiantoday.com\/?p=27787"},"modified":"2018-12-07T11:49:14","modified_gmt":"2018-12-07T11:49:14","slug":"leicester-company-nylacast-fined-293k","status":"publish","type":"post","link":"https:\/\/www.theasiantoday.com\/index.php\/2018\/12\/07\/leicester-company-nylacast-fined-293k\/","title":{"rendered":"Leicester Company Nylacast Fined \u00a3293K"},"content":{"rendered":"<p><span lang=\"EN-GB\">A\u00a0Leicester company has been fined almost \u00a3300,000 after a death of one of its employer who died following an industrial accident. <\/span><\/p>\n<p><span lang=\"EN-GB\">Nylacast Limited was fined \u00a3293,000 after 52-year-old Tarsem Singh, of Oadby, died from a heart attack in hospital the day after sustaining injuries while removing a plastic rod from a casting machine.<\/span><\/p>\n<p><span lang=\"EN-GB\">The company, which manufactures plastics products for the construction and offshore industries, was also ordered to pay more than \u00a310,000 in costs.<\/span><\/p>\n<p><span lang=\"EN-GB\">District Judge Tim Daber, handing down his sentence at Northampton Magistrates Court after the company pleaded guilty to two breaches of health and safety regulations at an earlier hearing in Leicester said it &#8220;was an accident waiting to happen\u201d.<\/span><\/p>\n<p><span lang=\"EN-GB\">Mr Singh\u2019s family, who were in court said no amount of fine or compensation could ever replace the loss of a dearly loved father and husband.<\/span><\/p>\n<p><span lang=\"EN-GB\">Leicester Magistrates Court heard in July that Mr Singh, of Oadby, an experienced operator on the bespoke machine was in the process of removing a cast plastic rod from a casting machine.<\/span><\/p>\n<p><span lang=\"EN-GB\">Mr Singh went to remove the rod from the machine, the metal retaining end cap and plastic rod were forcibly ejected, hitting Mr Singh in the chest at an estimated speed of 81mph, with a force of up to eight tonnes.<\/span><\/p>\n<p><span lang=\"EN-GB\">He died of a heart attack the following day in hospital due to his injuries, caused by the \u201cblunt force impact\u201d which cracked Mr Singh\u2019s breast bone and jaw, knocking out several teeth.<\/span><\/p>\n<p><span lang=\"EN-GB\">An investigation by the Health and Safety Executive (HSE) into the incident on April 15, 2016, found that the company failed to undertake a suitable and sufficient assessment of the long length rod machine in order to ensure that all foreseeable hazards had been identified.<\/span><\/p>\n<p><span lang=\"EN-GB\">Nylacast, employs 530 people around the world, 125 of them on a round the clock operation at the Thurmaston Boulevard site, pleaded guilty to breaching Regulation 3 of the Management of Health and Safety at Work Regulations 1999 and Regulation 12 of the Provision and Use of Work Equipment Regulations 1998.<\/span><\/p>\n<p><span lang=\"EN-GB\">Sentencing, District Judge Daber said: \u201cThere was no engineering measure which prevented the ejection of the end cap before pressure in the mould had been released.<\/span><\/p>\n<p><span lang=\"EN-GB\">\u201cThe failings in this case were not an isolated incident as the risk existed each time the machine was used. In this court\u2019s judgement, this was an accident waiting to happen.\u201d<\/span><\/p>\n<p><span lang=\"EN-GB\">Mr Singh\u2019s 21-year-old son Kuldip, speaking on the family\u2019s behalf, said: \u201cNo amount of financial penalty could ever take account of the loss of my father.<\/span><\/p>\n<p><span lang=\"EN-GB\">The family is pursuing a civil claim for compensation against Nylacast.<\/span><\/p>\n<p><span lang=\"EN-GB\">In a statement, Nylacast reiterated its \u201csincerest condolences&#8221; to the family of Tarsem Singh.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A\u00a0Leicester company has been fined almost \u00a3300,000 after a death of one of its employer who died following an industrial accident.
